Tantya Terms of Service

1. Acceptance of these terms

By creating an account or using Tantya ("the App," "we," "us"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.

2. What Tantya is

Tantya is a free tool that helps construction contractors in the Philippines calculate material quantities, build quotations, and manage related project records (schedule, payments, expenses, worker attendance, etc.). Tantya:

• Is free of charge. We do not currently charge subscription fees, commissions, or transaction fees. We may introduce paid features in the future; if we do, we will give advance notice and will not silently start charging an active free account.
• Does not process payments. Payment/expense features are manual record-keeping only; Tantya never touches your or your customers' money. Any "buy now, pay later" checkout link you add is a link to a third party's own payment page.
• Provides estimates, not professional advice. All quantities, prices, and cost totals produced by the App — including AI-generated material estimate drafts — are estimates only. They are not a substitute for a licensed engineer's structural design, a supplier's final quotation, or professional legal/tax/financial advice. Always verify quantities and current prices with your suppliers before committing to a project.
• Does not represent government or official pricing. Default material prices in the App are either our own researched reference values or values you enter yourself — never scraped from or presented as official government data.

3. Your account

• You must provide accurate information when creating an account and keep your login credentials confidential.
• You are responsible for all activity under your account, including actions taken by team members you invite.
• You must be legally capable of entering into a contract under Philippine law to use Tantya.

4. Your responsibility for data you enter about others

When you enter a customer's or worker's name, contact details, wages, or other personal data into Tantya, you are the party responsible, under the Data Privacy Act, for having a lawful basis (such as their consent or your contractual relationship with them) to process that data. Tantya provides the platform; you control what you enter and who you share it with (e.g., via a share link).

5. Acceptable use

You agree not to:

• Use the App for any unlawful purpose, or to store or transmit data you do not have the right to store or transmit;
• Attempt to probe, scan, or attack the App's infrastructure, bypass rate limits or usage quotas, or interfere with other users' access;
• Use the AI material-estimate feature to generate content unrelated to construction estimating, or attempt to extract our system prompts or abuse the underlying AI provider's terms;
• Misrepresent Tantya-generated estimates as official, government-issued, or professionally certified figures without independent verification.

We automatically detect and block common attack patterns (e.g., vulnerability scanning) and log site visits for security purposes (see our Privacy Policy). We may suspend or terminate accounts that violate this section, including accounts flagged for abusive use of rate-limited features (e.g., excessive AI estimate requests from the same account or network).

6. Intellectual property

Tantya's software, design, and content (excluding data you enter) belong to us or our licensors. You retain ownership of the project, customer, and business data you enter. By using the App you grant us a limited license to host, process, and display that data solely to provide the service to you (and to whomever you choose to share a link with).

7. Third-party services and links

Tantya integrates with or links to third-party services you may configure (webhook endpoints, BNPL checkout links) or that we rely on to operate (Supabase, Vercel, Anthropic). We are not responsible for the content, security, or practices of third-party services, including ones you configure yourself.

8. Disclaimer of warranties

The App is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that estimates will be accurate for your specific project.

9. Limitation of liability

To the maximum extent permitted by Philippine law, we are not liable for indirect, incidental, or consequential damages arising from your use of the App, including reliance on any estimate, calculation, or AI-generated content. To the same extent permitted by law, our total liability for any claim relating to the App is limited to the amount you paid us in the preceding 12 months (currently zero, as the App is free), except for liability arising from our gross negligence, fraud, or willful misconduct, or as otherwise required by applicable law — nothing in this section waives any liability that cannot lawfully be waived under the Civil Code of the Philippines.

10. Suspension and termination

We may suspend or terminate your access if you violate these terms, misuse rate-limited features, or if required by law. You may stop using the App and request deletion of your account at any time by contacting us.

11. Changes to these terms

We may update these terms as the App evolves. Continued use after an update means you accept the revised terms. Material changes will be flagged in-app where reasonably possible.

12. Governing law

These terms are governed by the laws of the Republic of the Philippines. Any dispute will be resolved in the appropriate courts of the Philippines, without prejudice to any mandatory consumer-protection venue rules.
